Is It Legal to Sell Prescription Drugs Online?
Yes, for a licensed pharmacy filling valid prescriptions. The federal rules, state licenses, controlled substances, and what processors check.
Article summary
Legal, with a prescriptionTL;DR
Yes, if you're a licensed pharmacy filling valid prescriptions. In the US, a prescription drug can be dispensed only on a licensed practitioner's prescription, and an online pharmacy needs a license where it operates and where it ships. Controlled substances add stricter federal rules. Selling without a prescription, or reselling your own medication, is illegal.
- Federal law says prescription drugs "shall be dispensed only" on the prescription of "a practitioner licensed by law".
- The FDA describes a safe online pharmacy as licensed "by the state board of pharmacy in your state and the state where the pharmacy is operating".
- The FDA reports that about 5% of roughly 35,000 online pharmacies comply with US pharmacy laws, citing NABP (figure last updated 2020).
- DEA telemedicine flexibilities for controlled substances run "January 1, 2026 through December 31, 2026".
- Visa bars every merchant from selling products that "claim or imply a similar efficacy as prescription drugs" (rules of October 24, 2026).

This guide is part of our hub on online pharmacy payment processing. The general guide, for any business: how to get a high-risk merchant account. It's general information, not legal advice. Brands that want the prescription side run for them can apply to Tagada Rx, a stack with storefront, doctors, pharmacy and payments.
The federal rule: a prescription, then a pharmacy
The Federal Food, Drug, and Cosmetic Act sets the base rule. A prescription drug "shall be dispensed only (i) upon a written prescription of a practitioner licensed by law to administer such drug", an oral prescription "reduced promptly to writing and filed by the pharmacist", or an authorized refill121 U.S.C. § 353(b)(1), read November 2, 2026.
Dispensing any other way is "an act which results in the drug being misbranded while held for sale"121 U.S.C. § 353(b)(1), read November 2, 2026. Selling online changes the channel, not the rule.

Watch out
If you're an individual with leftover medication, you can't legally sell it, online or off. Federal law ties dispensing to a practitioner's prescription121 U.S.C. § 353(b)(1), read November 2, 2026, and every major marketplace bans the listing: can you sell prescription drugs on Amazon, eBay or Facebook?
What makes an online pharmacy legal
Legality rests mainly on state pharmacy licenses plus the federal rules above. The FDA's checklist is what regulators, processors and certifiers look for2FDA, BeSafeRx: Frequently Asked Questions, content current as of September 21, 2020.
| Condition | What the FDA says | Why it matters for payments |
|---|---|---|
| State licenses | Licensed "by the state board of pharmacy in your state and the state where the pharmacy is operating" | Underwriters ask for each license |
| A valid prescription | "Requires a prescription from a licensed healthcare professional" | NoPrescription, no lawful sale |
| A US address | "Provides a physical address in the United States" | Shown on your site and in your file |
| A pharmacist | "Has a state-licensed pharmacist available to answer your questions" | Part of the certification review |
FDA, BeSafeRx FAQ, content current as of September 21, 20202FDA, BeSafeRx: Frequently Asked Questions, content current as of September 21, 2020.
The FDA also points consumers to each state board's license lookup and says "If your online pharmacy is not listed, you should not use that pharmacy"3FDA, BeSafeRx: Locate a State-Licensed Online Pharmacy, content current as of November 13, 2024. Your licenses are public, and so is their absence.

State licenses
Licensed "by the state board of pharmacy in your state and the state where the pharmacy is operating".
A valid prescription
"Requires a prescription from a licensed healthcare professional".
A US address
"Provides a physical address in the United States".
A pharmacist
"Has a state-licensed pharmacist available to answer your questions".
Each one is also a line in your merchant file.

Controlled substances: stricter rules
For controlled substances, the Ryan Haight Act adds a federal layer on top of state law.
- A valid prescription for internet sales. "No controlled substance that is a prescription drug [...] may be delivered, distributed, or dispensed by means of the Internet without a valid prescription"521 U.S.C. § 829(e). In principle, that requires "at least 1 in-person medical evaluation"521 U.S.C. § 829(e).
- State licenses where you ship. The pharmacy must comply with state licensure "in each State from which it, and in each State to which it" delivers controlled substances421 U.S.C. § 831.
- Disclosures on your homepage. An online pharmacy dispensing controlled substances must post a statement of compliance and details such as its address and pharmacist in charge421 U.S.C. § 831.
- A deadline. Telemedicine flexibilities that relax the in-person rule run "January 1, 2026 through December 31, 2026"6Federal Register, document 2025-24123 (90 FR 61301), December 31, 2025. Check their status before 2027.

Plan for the in-person rule unless the flexibilities are extended.
Decide before you apply whether you'll dispense controlled substances at all: it changes your licenses, your homepage and the questions your processor asks.
What regulators treat as illegal
The FDA lists the signs of an illegal online pharmacy. Avoid each of them on your own site2FDA, BeSafeRx: Frequently Asked Questions, content current as of September 21, 2020.
- It lets customers "buy medicine without a prescription from your doctor"
- It states "the medicine will be shipped from a foreign country"
- It is "not licensed by a state board of pharmacy in the United States"
On foreign supply, the FDA adds that it "does not have regulatory oversight of prescription medicine from outside the legitimate U.S. drug supply chain"2FDA, BeSafeRx: Frequently Asked Questions, content current as of September 21, 2020.
Legal is not the same as payable
Being legal gets you a hearing with a processor. It doesn't get you approved. Card networks and processors add their own rules.
| Rule | What it says |
|---|---|
| Visa, all merchants | NoCard acceptance for products that "claim or imply a similar efficacy as prescription drugs, controlled substances, or recreational/street drugs, irrespective of claims of legality" (Visa)7Visa Core Rules and Visa Product and Service Rules, October 24, 2026, sections 1.9.2.1 and 1.9.5.1 |

The law is the first answer, not the last.
Tagada follows Visa and Mastercard rules and the laws that apply to payments.
HIPAA is a separate question. It doesn't apply to the payment step itself1142 U.S.C. § 1320d-8 (Social Security Act § 1179), but your pharmacy system does handle protected health data. The full rule set for your merchant account: online pharmacy merchant account compliance.
