Trial Offers for Fitness Brands: Rules and Conversion

Equipment home trials and nutrition trials that become subscriptions: ROSCA, California, Visa and Mastercard rules, and a flow that avoids disputes.

Article summary

TL;DR

Fitness brands run two kinds of trials. An equipment "home trial" is paid upfront, with a 30-day return window, judged under Visa's "not as described" rules. A sports nutrition trial that turns into a subscription is a negative option: ROSCA and Visa require clear terms, express consent, a reminder at least 7 days before the charge and online cancellation.

  • Peloton's home trial runs "up to 30 days from your delivery date", with upfront payment and a $150 to $250 return fee (read November 2, 2026).
  • Mastercard requires the trial of a physical product to start when the customer receives it, as reported by J.P. Morgan in 2019.
  • ROSCA requires terms before billing details, express informed consent and a simple way to stop charges for any online negative option.
  • Visa requires a notice at least 7 days before a trial or intro price ends, with online cancellation (Visa rules, April 18, 2026).
  • California requires a notice 3 to 21 days before the end of a free trial longer than 31 days.

This page is about trials sold online by fitness product brands. Gym and club memberships follow the same subscription rules, but their trial offers are a different business.

Two kinds of fitness trials

The word "trial" covers two models with different rules. Know which one you run before you write the checkout.

Equipment home trials

Big equipment brands sell trust with a home trial. Their published terms show the common pattern: the clock starts on delivery, the customer pays upfront, and returns cost something.

Starting the trial at delivery matches what Mastercard requires for physical-product trials, as relayed by J.P. Morgan4J.P. Morgan, "Mastercard Announces Revised Standards for Free Trial Merchants", 2019 (acquirer communication; current Mastercard standards not public). A trial that starts at the order date can end before a backordered machine arrives.

The payment risk is the return. Under Visa's 13.3 rule, a customer can dispute "not as described" if they returned or tried to return the item, and the attempt counts if you refused the return or "did not provide clear instructions on how to return"3Visa Core Rules and Visa Product and Service Rules, edition of October 24, 2026, dispute condition 13.3 (p. 767 to 769).

Watch out

A return fee the customer didn't see before buying is a dispute waiting to happen. Show it on the product page and at checkout.

Nutrition trials that turn into subscriptions

A free or $1 first tub of protein that becomes a monthly refill is a negative option: the customer keeps paying until they stop it. It's legal in the US, under conditions.

ROSCA applies to any negative option sold online. You must disclose all material terms before taking billing information, get express informed consent before charging, and provide simple ways to stop recurring charges5Restore Online Shoppers' Confidence Act, 15 U.S.C. § 8403. The FTC's 2024 click-to-cancel rule was vacated in 2025; its new rulemaking opened in March 202610FTC, advance notice of proposed rulemaking on negative option plans, 91 FR 12318, March 13, 2026. ROSCA still applies.

Visa adds checkout and reminder rules for every merchant that accepts its cards7Visa Core Rules and Visa Product and Service Rules, edition of April 18, 2026, section 5.8.17.2, tables 5-20, 5-21 and 5-31, dispute conditions 13.2 and 13.5:

California is stricter on timing. For a free trial longer than 31 days, the reminder goes out 3 to 21 days before it ends, and online sign-ups need online cancellation6California Business and Professions Code § 17602, as amended for contracts from July 1, 2025. Build the whole flow to California's standard if you ship there.

What processors and networks watch

Tagada follows Visa and Mastercard rules and the laws that apply to payments.

A compliant trial flow

  1. Show the terms above the pay button: trial length, what's charged after, when, how often, how to cancel.
  2. Collect consent with a click-to-accept box, unchecked by default, separate from general terms.
  3. Send a receipt with the terms and a cancellation link.
  4. Start equipment trials at delivery, not at order.
  5. Send the reminder at least 7 days before the first paid charge; for trials over 31 days, 7 to 21 days covers Visa and California6California Business and Professions Code § 17602, as amended for contracts from July 1, 20257Visa Core Rules and Visa Product and Service Rules, edition of April 18, 2026, section 5.8.17.2, tables 5-20, 5-21 and 5-31, dispute conditions 13.2 and 13.5.
  6. Let customers cancel online, in as few steps as they signed up.
  7. Keep the record: what was shown, when consent was given, every reminder sent.

Built to Visa's rules and California's timing, which also cover ROSCA's basics.

What converts without disputes

A trial that converts badly usually shows up later as disputes, not as lost signups. Measure conversion and dispute rate together, per offer.

  1. Pick an honest first price

A small paid first order filters out people who never meant to subscribe.

  2. Make the second shipment flexible

Skip, delay or change flavor instead of cancel.

  3. Say what's in the box and when it arrives

Not what it will do for the body. Result claims fuel "not as described" disputes and FTC issues.

  4. Track by traffic source

An ad that overpromises fills the trial with future disputes.

The retention side, with skip and pause flows: subscriptions and churn for fitness brands.

Frequently asked questions

When does a fitness equipment home trial start?

Most brands start it on delivery: Peloton gives "up to 30 days from your delivery date", MERACH "within 30 days of delivery". Mastercard requires physical-product trials to start when the customer receives the product, as reported by J.P. Morgan. Starting at delivery also avoids disputes on backorders.

Can I charge a return fee on a home trial?

Yes, if it's disclosed before purchase. Peloton charges $150 to $250 and MERACH $100 to $350. Show the fee next to the offer and give clear return instructions: under Visa's 13.3 rule, a customer who got no clear instructions can still win a "not as described" dispute.

Is a free trial that auto-renews legal?

Yes in the US, if you meet ROSCA: material terms before billing information, express informed consent, and a simple way to stop charges. California adds timing rules for reminders, and Visa requires a notice at least 7 days before the trial ends.

What is the 7-day rule for free trials?

It's Visa's rule. At least 7 days before the first charge after a free trial, introductory offer or promotion, you must notify the customer with the amount, the date and how to cancel online. It applies to every merchant accepting Visa, whatever the processor.

Does Stripe allow free trials for protein or pre-workout?

Stripe doesn't ban trials. It lists "reduced price trials with unclear or hidden pricing" and negative option clubs among unacceptable practices. A trial with clear terms, consent and easy cancellation isn't the target. Product claims are judged separately under Stripe's nutraceutical rules.
