Trial Offers for Online Pharmacies: Rules and Conversion
Can an online pharmacy offer a free trial? Visa, ROSCA and California rules for intro offers, what prescriptions change, offers that convert cleanly.
Article summary
TL;DR
A free trial of a prescription medication is rare and draws scrutiny. A clear intro offer, such as a reduced first month, works if it follows Visa's rules, ROSCA and state laws: terms at checkout, express consent, notice at least 7 days before full price, online cancellation. The prescription comes first, and refills can't outrun it.
- Visa requires trial terms on the checkout screen, a "click-to-accept" consent and a notice at least 7 days before a trial or intro price ends (rules of April 18, 2026).
- ROSCA requires clear terms before billing details, express informed consent and a simple way to stop charges.
- The FTC's click-to-cancel rule was vacated in 2025; a new rulemaking opened on March 13, 2026, with no rule since.
- Since March 31, 2026, Google lets certified US online pharmacies promote prescription subscriptions in Merchant Center, with all fees disclosed.
- Stripe prohibits "reduced price trials with unclear or hidden pricing".

The rules for a trial or intro offer
An offer that turns into recurring charges unless the patient cancels is a negative option. These rules apply to it.
7 days
Minimum notice before the first full-price charge (Visa)
3 to 21 days
California notice before a trial longer than 31 days ends
Online
Cancellation, when the order was taken online (Visa, California)
Tagada follows Visa and Mastercard rules and the laws that apply to payments.
What changes for a pharmacy
A trial can't skip the clinical steps. Everything about the offer sits after a valid prescription and before a dispensing decision.
| Topic | What it means |
|---|---|
| Prescription first | NoDispensing without a valid prescription; the offer can't promise the medication before review (State and federal pharmacy law) |
| Refill limits | A refill plan stops where the prescription stops; for Schedule III and IV controlled substances, no refill after 6 months or beyond 5 refills (21 CFR 1306.22)721 CFR 1306.22(a) |
| NoTake-backs | Dispensed medication usually can't come back for a refund; Georgia makes it unlawful except where law permits (Ga. 480-16-.03)8Georgia Comp. R. & Regs. 480-16-.03, effective February 9, 2016 |
| Ads and Shopping | Certified US online pharmacies may run recurring billing offers on Google, disclosing all fees and whether the price covers the medication only or a bundled treatment plan (Google Merchant Center)6Google Merchant Center Help, Recurring billing policy expansion: Prescription drugs, effective March 31, 2026 |
Watch out
A "money-back guarantee" that implies returning the product doesn't work for dispensed prescriptions8Georgia Comp. R. & Regs. 480-16-.03, effective February 9, 2016. If you offer a refund promise, say exactly what is refunded and when, without asking for the medication back.
