How to Start and Scale a Skincare Brand

Launch a skincare brand step by step: MoCRA, cosmetic claims, state ingredient laws, manufacturer, store, payments, channels, then scaling.

Article summary

TL;DR

To start a skincare brand, choose a manufacturing model, keep every claim cosmetic, meet MoCRA's duties (product safety records, adverse event reporting, a US contact on the label, and registration and listing unless you qualify as a small business), check state ingredient bans, then set up a store and a processor before buying ads. To scale, sell routines, add subscriptions and a backup processor.

  • The FDA doesn't approve cosmetics before sale, but MoCRA requires facility registration every two years, product listing with annual updates and serious adverse event reports within 15 business days.
  • Small businesses under $1 million in average annual sales are exempt from registration, listing and GMP, with exceptions such as eye-area and long-lasting products.
  • "Moisturizing is a cosmetic claim"; removing wrinkles or increasing collagen makes it a drug or device.
  • California and Washington ban listed ingredients from January 1, 2025; Washington's law covers products sold into the state online.
  • Shopify beauty brands acquire customers at a $44.29 median CAC (Polar, August 2026).

Watch out

The exemption does not remove every duty. The text names only registration, listing and GMP, so safety records, adverse event reporting and labeling still apply. FDA guidance doesn't spell this out in one sentence; read it as the statute's wording. This is general information, not legal advice.

Frequently asked questions

Do I need FDA approval to sell skincare?

No. Cosmetics don't need FDA approval before sale. Under MoCRA you must keep safety records, report serious adverse events within 15 business days, and, unless you are an exempt small business, register facilities and list products. Claims to treat skin conditions make a product a drug.

What is the MoCRA small business exemption?

Businesses with less than $1 million in average annual sales over three years are exempt from facility registration, product listing and GMP requirements. The exemption doesn't apply to products for the eye area, injected or internal products, or products that alter appearance for more than 24 hours.

Can I sell skincare on Amazon?

Yes, with approval by product rather than by category. Amazon asks for an invoice less than 180 days old for at least 10 units from an authorized distributor, according to its seller blog. Some peels are limited in concentration.

What breaks first when a skincare brand scales?

Usually acquisition cost and dependence on one processor. Raise order value with routines, add refills and subscriptions, and set up a backup processor before you double ad spend.
