Fitness Product Merchant Account Compliance: The Rules to Follow

The rules that keep a fitness merchant account open: merchant codes, dispute thresholds, delivery proof, subscription rules, claims and affiliates.

Article summary

TL;DR

Keeping a fitness merchant account means following three sets of rules at once: the card networks' (merchant code, dispute thresholds, delivery and return evidence, subscription rules), the regulators' (FTC rules on claims, reviews and affiliates; FDA rules for sports nutrition), and your processor's own policy. For equipment, delivery proof decides most disputes. Check them every month, not only at approval.

  • Visa flags US merchants at 1.5% fraud plus disputes, with at least 1,500 cases a month, since April 1, 2026.
  • To fight a Visa "not received" dispute you need "proof of delivery that contains the full delivery address" (rules of October 24, 2026).
  • Mastercard requires merchants billing physical products on negative option to register and use MCC 5968.
  • The FTC's final rule of August 14, 2024 bans fake reviews and testimonials, including AI-generated ones.
  • You can be liable for an affiliate's deceptive claim "even when the endorser is not liable".

Frequently asked questions

What MCC does a fitness equipment store use?

Usually 5941, Visa's code for sporting goods stores, which covers sports equipment and accessories. A sports nutrition shop may sit under 5499, and a brand billing refills on negative option under 5968, which Mastercard requires for that model.

What is the chargeback limit for a fitness brand?

The same as for any card-not-present merchant: Visa flags US merchants at 1.5% fraud plus disputes, with at least 1,500 cases a month; Mastercard at 1.5% and 100 chargebacks. Processors usually act earlier.

How do I win a "not received" dispute on a treadmill?

Under Visa condition 13.1, send "proof of delivery that contains the full delivery address"; tracking with a partial address isn't accepted. If the buyer cancelled before the expected delivery date, the dispute isn't valid under the same rules.

Am I liable for what my affiliates and influencers say?

Yes. Under 16 CFR 255.1(d), an advertiser can be liable for a deceptive endorsement "even when the endorser is not liable". Paid or gifted endorsers must disclose the relationship. Give affiliates an approved list of claims.

Can I use AI-generated reviews or testimonials?

No. The FTC's final rule of August 14, 2024 bans fake reviews and testimonials, including AI-generated ones, and lets the FTC seek civil penalties against knowing violators. Stripe also prohibits "fake testimonials".
