PayPal and High-Risk Subscriptions: What Is Allowed
PayPal supports subscriptions and trials. The User Agreement rules for recurring payments, where negative option starts, and what gets accounts held.
Article summary
TL;DR
PayPal supports subscriptions, trials included. Its Acceptable Use Policy doesn't name subscriptions or negative option offers. The rules sit in the User Agreement: get the buyer's authorization for amount, frequency and duration, offer simple online cancellation, never restart a canceled plan. PayPal's Braintree docs add that negative option billing "is generally prohibited amongst banking partners".
- PayPal's Acceptable Use Policy, last updated October 29, 2022, has no line on subscriptions, trials or negative option marketing.
- The User Agreement (September 14, 2026) requires each buyer's "prior authorization for the amount, frequency, and duration" of recurring payments.
- Buyers must be able to stop a payment up to 3 business days before it's due, and get 10 days' notice when the amount changes.
- PayPal Subscriptions allows up to 2 trial periods per plan, and retries a failed payment every 5 days, up to twice per billing cycle.
- Braintree's docs say negative option billing "is generally prohibited amongst banking partners".
On this page
This page covers PayPal's rules for subscription businesses. For how recurring card payments work at any processor, see subscription payment processing. More PayPal guides are in the PayPal hub.
What PayPal allows and what it prohibits
Recurring billing is a standard PayPal product: the User Agreement calls it a "billing agreement," "subscription," "recurring payment" or "automatic payment"2PayPal User Agreement, last updated September 14, 2026, read November 3, 2026. Unlike Stripe, PayPal's Acceptable Use Policy has no negative option line1PayPal Acceptable Use Policy, last updated October 29, 2022, read November 3, 2026. The obligations are in the User Agreement, section on preauthorized payments2PayPal User Agreement, last updated September 14, 2026, read November 3, 2026.
Get each buyer's prior authorization for the amount, frequency, and duration of any such payment.
| Offer | Status on PayPal | Why |
|---|---|---|
| Plan with a clear price, interval and online cancellation | Allowed | Matches the User Agreement rules2PayPal User Agreement, last updated September 14, 2026, read November 3, 2026 |
| Free or discounted trial, disclosed, with a reminder | Allowed | PayPal Subscriptions supports up to 2 trial periods4PayPal Developer, Offer a trial period, updated October 14, 2026 |
| Trial that bills without warning or an easy way out | Against PayPal's own guidance | Braintree: "generally prohibited amongst banking partners"3PayPal Braintree Docs, Trial periods, read November 3, 2026 |
| Restarting payments a buyer stopped | Prohibited | "without the buyer's written authorization"2PayPal User Agreement, last updated September 14, 2026, read November 3, 2026 |
| Price changes without notice | Prohibited | 10 days' notice of amount and date when it varies2PayPal User Agreement, last updated September 14, 2026, read November 3, 2026 |
| Product on the pre-approval list (telemedicine, prescription items, dating...) | Needs approval first | See PayPal prohibited businesses1PayPal Acceptable Use Policy, last updated October 29, 2022, read November 3, 2026 |
Two more User Agreement lines apply to every subscription seller. You must publish customer service contact details and a refunds and returns policy2PayPal User Agreement, last updated September 14, 2026, read November 3, 2026. And you must not run your business in a way that results in "requests by buyers (either filed with us or card issuers) to invalidate payments made to you"2PayPal User Agreement, last updated September 14, 2026, read November 3, 2026.
Where the negative option line sits
PayPal's Braintree docs define it. "The failure to alert the customer prior to their charge, or give them the option to opt-out, will result in something referred to as negative option billing"3PayPal Braintree Docs, Trial periods, read November 3, 2026.
They add that it "puts you at an increased risk of chargebacks" and recommend "notifying customers of the first billing date towards the end of their trial period"3PayPal Braintree Docs, Trial periods, read November 3, 2026.
So the line is the warning, not the trial. A trial with a reminder and an easy cancel reads as a disclosed subscription. The same trial without them reads as negative option billing.
Fig. 1Two trial funnels, two outcomes on PayPal
Reads as a disclosed subscription
- Trial length, price after the trial and billing frequency next to the pay button
- Buyer approves the amount, frequency and duration
- Reminder before the first full charge, with a cancel link
- Cancellation online, in a few clicks
Reads as negative option billing
- "Just pay shipping" with the monthly price in the terms only
- No alert before the first charge
- Cancellation only by phone or email
- Payments restarted after the buyer canceled
same product, different disclosure

Trial and renewal rules, and the PayPal tools for each
PayPal gives you the billing engine. The disclosures and reminders are mostly yours: the developer pages we read describe trial periods and retries, not a trial reminder email4PayPal Developer, Offer a trial period, updated October 14, 20265PayPal Developer, Payment failures and recovering balances, updated October 14, 2026. Braintree says it plainly: "Customers are not alerted by default when they enter the first billing cycle"3PayPal Braintree Docs, Trial periods, read November 3, 2026.

Watch out
A buyer can stop an automatic payment from their PayPal account 3 business days or more before it's due2PayPal User Agreement, last updated September 14, 2026, read November 3, 2026. Sync cancellations from PayPal into your own system, or you'll ship to subscribers who already left.
Your MCC and network registration
Physical goods sold on subscription through direct marketing fall under Visa's MCC 5968, which Visa lists among its high-risk codes for card-absent sales8Visa, Merchant Data Standards Manual, April 2026. Mastercard requires registration for negative option merchants selling at a distance and imposes MCC 5968 on them9Mastercard, Security Rules and Procedures, Merchant Edition, section 9.4.10, February 11, 2025. Your offer decides the code. More: MCC 5968.
What gets subscription accounts held or limited on PayPal
Disputes, mostly. PayPal lists "an unusually high number of claims and chargebacks" among the reasons for a limitation, along with a rapid rise in sales volume2PayPal User Agreement, last updated September 14, 2026, read November 3, 2026. Its reserve criteria include "Whether your industry has a higher likelihood of chargebacks" and "higher than average number of returns, chargebacks, claims or disputes"2PayPal User Agreement, last updated September 14, 2026, read November 3, 2026.

- A launch doubles weekly sign-ups"typical sales volume increases rapidly"Keep claims low and answer document requests fast

The High Volume Dispute fee applies when your dispute ratio is 1.5% or more and you had more than 100 sales in the previous three full calendar months2PayPal User Agreement, last updated September 14, 2026, read November 3, 2026. In the US it's $30 per dispute, against $15 at the standard rate10PayPal, Merchant and business fees (US), updated October 1, 2026.
PayPal's own advice is to keep buyer complaints "below 1% of sales"14PayPal, The why and what of account reserves, November 17, 2025. Thresholds in detail: PayPal chargebacks.
If PayPal finds a breach of its Acceptable Use Policy, it can hold your balance "for up to 180 days"2PayPal User Agreement, last updated September 14, 2026, read November 3, 2026. What follows: PayPal account limited.
Renewals that fail
PayPal Subscriptions retries for you. "If a payment fails, PayPal retries the payment every 5 days," up to twice per billing cycle5PayPal Developer, Payment failures and recovering balances, updated October 14, 2026. After the second failed retry, the amount is added to the next cycle's balance, and once the payment_failure_threshold you set is reached, "The subscription is suspended"5PayPal Developer, Payment failures and recovering balances, updated October 14, 2026.
- Day 0: the renewal fails.
- Days 5 and 10: PayPal retries.
- If both fail: one payment failure is counted, and the amount rolls into the next bill.
- At your threshold: the subscription is suspended; you can capture the outstanding balance or settle offline.
PayPal Developer, Payment failures and recovering balances, updated October 14, 2026.
Rolling a failed month into the next bill doubles the next charge. Tell the subscriber before you collect it, since the amount differs from the one they approved2PayPal User Agreement, last updated September 14, 2026, read November 3, 2026. Visa's own ceiling for card retries is 20 attempts in 30 days, and none after a category 1 decline11Visa Core Rules and Visa Product and Service Rules, sections 1.7.2.1 and 7.3.6.3, edition October 24, 2026.
Pay Later doesn't fit subscriptions: "Reference Transaction and Recurring Payment integrations aren't eligible for Pay Later products"12PayPal Developer, Pay Later (United States), updated October 20, 2026. And charging a saved PayPal wallet outside a plan needs approval: "You must be approved and have your account configured for billing agreements to set up a reference transaction"13PayPal Developer, Save PayPal for purchase later, updated October 29, 2026.
Upsells on a subscription
Allowed when the buyer approves them. Since recurring payments need authorization "for the amount, frequency, and duration"2PayPal User Agreement, last updated September 14, 2026, read November 3, 2026, an add-on that raises the renewal needs its own consent, never a default checkbox. How a compliant post-purchase offer works: one-click upsell.
