Stripe and High-Risk Subscriptions: What Is Allowed
Stripe supports subscriptions but prohibits negative option marketing and hidden-price trials. Where the line sits, the rules to follow, what triggers a review.
Article summary
TL;DR
Stripe supports subscriptions, trials included, through Stripe Billing. What it prohibits is "negative option marketing, negative option membership clubs, and reduced price trials with unclear or hidden pricing", plus high-pressure upselling. A subscription with clear terms, reminders and easy cancellation is allowed. Hidden terms, rising disputes or an undeclared change get you reviewed.
- Stripe's list, updated September 22, 2026, prohibits "Negative option marketing, negative option membership clubs, and reduced price trials with unclear or hidden pricing".
- The same list prohibits businesses that "use high-pressure upselling".
- Stripe Billing sends a trial reminder 7 days before a trial ends, and adds "* TRIAL OVER" to the statement descriptor after it.
- Stripe's terms let it act when you change your business model "without Stripe's prior consent".
- Smart Retries defaults to 8 tries within 2 weeks and never retries 9 hard decline codes without a new card.
On this page
This page covers Stripe's rules for subscription businesses. For how recurring card payments work at any processor, see subscription payment processing. More Stripe guides are in the Stripe hub.
What Stripe allows and what it prohibits
Recurring billing itself is a standard Stripe product. The prohibited lines are about how the offer is sold. They sit under "Unfair, deceptive, or abusive acts or practices", which Stripe ties to the rules of the FTC, the CFPB and local consumer regulators1Stripe, Prohibited and restricted businesses, updated September 22, 2026, read November 2, 2026.
Negative option marketing, negative option membership clubs, and reduced price trials with unclear or hidden pricing

| Trial or intro price with unclear or hidden pricing | Prohibited | Named on the list1Stripe, Prohibited and restricted businesses, updated September 22, 2026, read November 2, 2026 |
| "Negative option" marketing or membership club | Prohibited | Named on the list1Stripe, Prohibited and restricted businesses, updated September 22, 2026, read November 2, 2026 |
| Upsell pushed with pressure, or fake testimonials | Prohibited | "high-pressure upselling", "fake testimonials"1Stripe, Prohibited and restricted businesses, updated September 22, 2026, read November 2, 2026 |
| Product on the restricted list (telemedicine, nutraceuticals with harmful claims...) | Depends on the product | See Stripe prohibited businesses |
Stripe's own guide also lists membership services and subscription boxes among businesses often treated as higher risk, because recurring payments draw more chargebacks9Stripe, High-risk merchant accounts explained, updated June 10, 2024. Allowed doesn't mean unwatched.
Where the negative option line sits
Stripe doesn't define "negative option" on its list. Read with its own trial documentation, the line looks like disclosure: Stripe Billing sells trials that convert to paid plans and tells you how to comply2Stripe Docs, Manage compliance requirements for trials and promotions, read November 2, 2026, while the list prohibits trials "with unclear or hidden pricing"1Stripe, Prohibited and restricted businesses, updated September 22, 2026, read November 2, 2026. That's our reading, not Stripe's wording: when in doubt, ask Stripe before launch.

Reads as a disclosed subscription
- Trial length, price after the trial and billing date next to the pay button
- A checkbox or button that confirms the recurring terms
- Reminder before the trial ends, with a cancel link
- Cancellation online, in a few clicks
Reads as negative option or hidden pricing
- "Just pay shipping" with the monthly price in the terms only
- No reminder before the first full charge
- Cancellation only by phone or email
- Extra products added to the subscription by default

Trial and renewal rules, and the Stripe tools for each
Stripe says it plainly: "You must comply with card network requirements when you use trial offers", and "if you don't use these settings, you're still responsible"2Stripe Docs, Manage compliance requirements for trials and promotions, read November 2, 2026. Here is how its tools line up with Visa's rules.

What each message does
- Reminder: sent 7 days before the trial ends, with a link to manage payment details.
- Receipt: shows trial information and the cancellation URL.
- Statement line: the trial text tells the cardholder the paid period has started.

each message closes a dispute reason
Two details trip merchants up. Stripe sends no trial reminders in a sandbox, so test the live setting2Stripe Docs, Manage compliance requirements for trials and promotions, read November 2, 2026. And a descriptor longer than 10 characters gets cut by the trial text: Stripe's limit is 22 characters2Stripe Docs, Manage compliance requirements for trials and promotions, read November 2, 2026.
Stripe's dispute guidance adds renewal reminders "typically 7 days before a yearly renewal and 2 to 3 days before a monthly renewal", and an in-app cancel button4Stripe Docs, Dispute and fraud card monitoring programs, read November 2, 2026.
Your MCC and network registration
Physical goods sold on subscription through direct marketing fall under Visa's MCC 5968, which Visa lists among its high-risk codes for card-absent sales7Visa, Merchant Data Standards Manual, April 2026. Mastercard requires registration for negative option merchants selling at a distance and imposes MCC 5968 on them8Mastercard, Security Rules and Procedures, Merchant Edition, section 9.4.10, February 11, 2025. Your processor handles the registration, but your offer decides the code. More: MCC 5968.
What gets subscription businesses reviewed on Stripe
Mostly disputes, and changes Stripe didn't hear about. The patterns below map to lines in Stripe's terms and list1Stripe, Prohibited and restricted businesses, updated September 22, 2026, read November 2, 20263Stripe Services Agreement, Service Terms: Stripe Payments Terms sections 5.3 to 5.5, modified September 28, 2026.

Stripe's prohibited uses also cover selling "products or services that weren't disclosed in the business's Stripe account application", and ask you to report changes "immediately"1Stripe, Prohibited and restricted businesses, updated September 22, 2026, read November 2, 2026. Where dispute levels start to matter: Stripe chargeback thresholds.
Watch out
When a review turns into a restriction, renewals stop with the rest. Stripe's card export doesn't include subscriptions, so keep your own records of plans and next charge dates. How to move them: migrate away from Stripe.
Renewals that fail
Stripe Billing retries them for you, within limits. Smart Retries lets you set a number of tries over 1 week to 2 months; the recommended default is "8 tries within 2 weeks"5Stripe Docs, Automate payment retries, read November 2, 2026. When retries run out, the subscription is canceled, marked unpaid, left past due or paused, as you chose5Stripe Docs, Automate payment retries, read November 2, 2026.
Stripe never retries these hard declines until the customer adds a new payment method5Stripe Docs, Automate payment retries, read November 2, 2026:

Visa's own ceiling is 20 attempts in 30 days, and none after a category 1 decline11Visa Core Rules and Visa Product and Service Rules, sections 1.7.2.1 and 7.3.6.3, edition October 24, 2026. Billing costs 0.7% of Billing volume on Stripe's pay-as-you-go plan10Stripe, Pricing and fees (United States), page as captured October 18, 2026, read November 2, 2026. Codes one by one: Stripe declined payments.
Upsells on a subscription funnel
Allowed when the customer chooses them. Stripe's list prohibits "high-pressure upselling"1Stripe, Prohibited and restricted businesses, updated September 22, 2026, read November 2, 2026, so the safe pattern is an offer after the first purchase, with its own price and its own consent, never a line added to the renewal by default. How a compliant post-purchase offer works: one-click upsell.
