How to Start and Scale a Telehealth Company
Launch a cash-pay telehealth brand step by step: structure, clinicians, pharmacy, payments, checkout, ads, then grow to more states and patients.
Article summary
TL;DR
To start a cash-pay telehealth company, choose your model, set up a structure that keeps clinical decisions with licensed clinicians, secure clinicians licensed in your patients' states and a partner pharmacy, get a processor that approves telemedicine, and build a checkout that charges only after approval. Launch in a few states, then scale by state, channel and retention.
- The Interstate Medical Licensure Compact covers 44 states, the District of Columbia and Guam, as a faster path to state licenses, not a national license.
- As of November 2, 2026, the DEA's temporary telemedicine flexibilities for prescribing controlled medications run through December 31, 2026.
- Stripe lists "Telemedicine and telehealth services" as restricted, and says telemedicine businesses don't need LegitScript to use it.
- Google and Meta require LegitScript certification before telehealth providers can advertise in the US.
- The FTC sued a large telehealth brand on July 29, 2026 over subscriptions, cancellation and health data (allegations).

The launch in 8 steps
Each step is a decision. Skipping one usually shows up later as a closed account or a rejected ad.
| # | Step | The decision | Detailed guide |
|---|---|---|---|
| 1 | Model | Consultation, treatment plan or membership | Funnel and offer |
| 2 | Structure | Who owns the clinical practice | Ownership and licensing |
| 3 | Clinicians and states | Where you can legally treat patients | Legal by state |
| 4 | Pharmacy | Who dispenses and ships | Consultation vs medication |
| 5 | Payments | Which processor approves your model | Telehealth payment processing |
| 6 | Stack | Storefront, quiz, checkout, refills | Tech stack |
| 7 | Ads | Certification and ad accounts | Ads and tracking |
| 8 | Launch | Start small, measure every step | Benchmarks |

Steps 2 to 4 are the regulated ones.
Step 1: choose your model
The model decides your checkout, your payments and your margins. Decide it before you talk to any vendor.
One-off consultation
A fee per visit; simple billing, low recurring revenue.
Treatment plan on subscription
Visit, treatment if prescribed and shipping, billed monthly or every few months.
Membership
A recurring fee for access to care, treatment billed separately.
Most direct-to-consumer brands are cash-pay. Insurance billing is a different business, with credentialing and claims. How to structure each offer: the telehealth sales funnel.
Step 2: set up a structure that keeps care with clinicians
In many states, a company that is not owned by physicians cannot practice medicine or employ doctors to do so. This is the corporate practice of medicine doctrine, and it varies by state.
- A common setup: a management company owned by the founders handles brand, technology and marketing, and a clinician-owned practice delivers care, under a management agreement, as described by clinical network providers12MD Integrations, MSO, PC and VCN in telehealth, December 9, 2025 (secondary source).
- The alternative: partner with an existing clinical network that already holds the licenses.
- Either way: clinical decisions stay with clinicians, and a healthcare attorney reviews the structure in your target states.
Watch out
This page is not legal advice. The rules differ by state and change. Get a healthcare attorney before you sign clinician or management agreements.
Step 3: clinicians licensed in your patients' states
The patient's location generally decides which state license the clinician needs. Plan your launch states around your clinicians, not around your ads.
- License per state: the Interstate Medical Licensure Compact offers "a voluntary, expedited pathway to licensure" in 44 states, the District of Columbia and Guam1Interstate Medical Licensure Compact Commission, A faster pathway to physician licensure, read November 3, 2026. It is not a national license.
- Ask the state first in your intake quiz, and stop patients you cannot serve.
- Target only served states in your ads.
Step 4: pharmacy and prescriptions
A telehealth brand sells the consultation and the plan. A licensed pharmacy dispenses and ships the medication.
- Partner with a licensed pharmacy that ships to your launch states.
- Keep the line clear between what you sell and what the pharmacy sells; it changes your payment setup. If you plan to sell and ship medication yourself, read online pharmacy payment processing.
- Controlled substances: the Ryan Haight Act requires a valid prescription, normally after "at least 1 in-person medical evaluation", for controlled substances delivered over the Internet221 U.S.C. § 829(e). The DEA's temporary flexibilities run through December 31, 20263DEA and HHS, Fourth Temporary Extension of COVID-19 Telemedicine Flexibilities for Prescription of Controlled Medications, 90 FR 61301, December 31, 2025 (effective January 1 to December 31, 2026). Check the rule again before any launch that depends on it.

Step 5: payments
Payments are the step founders leave for last, and the one that stops launches.
| Question | What the rules say |
|---|---|
| Will Stripe accept me? | "Telemedicine and telehealth services" are restricted: reviewed case by case, with license numbers and process details4Stripe, Prohibited and restricted businesses, read November 2, 20265Stripe Support, Prohibited and Restricted Business List FAQs, read November 2, 2026 |
| Do I need LegitScript for Stripe? | No"Telemedicine businesses don't need certification from LegitScript"5Stripe Support, Prohibited and Restricted Business List FAQs, read November 2, 2026 |
| Which merchant category code? | Usually 8011 (doctors) or 8099 (medical services); your acquirer decides6Visa Merchant Data Standards Manual, October 2026 |
| Can I send health data to the processor? | NoStripe's agreement bars sending Protected Health Information13Stripe Services Agreement, section 4 (Third Party Data), amended September 28, 2026 |
Plan a second processor from day one, so one review does not stop your sales: payment routing and backup processors. The MCC detail is on our MCC 8099 page.
Step 6: the stack
The stack connects the patient's journey to the clinician's decision and the pharmacy.
- Storefront and landing pages.
- Intake quiz with eligibility questions first.
- Checkout with a card hold, captured only after approval.
- Clinician review and e-prescribing, through your clinical partner.
- Pharmacy routing and shipping.
- Subscriptions and refills billed when each order ships, with online cancellation9Restore Online Shoppers' Confidence Act, 15 U.S.C. § 8403.
- Email and SMS without health details in subject lines.
- Server-side tracking with no health data in events.
The payment follows the clinical decision, not the other way around.
Which platform fits: best ecommerce platform for telehealth companies. Store or funnel: Shopify or a sales funnel?
Step 7: ads
Paid social and search drive most DTC telehealth launches, and both have entry requirements.
- LegitScript certification for your domain, required by Google and Meta for telehealth providers7Google Ads policy, prescription drug services, read November 2, 20268Meta Advertising Standards, Drugs and pharmaceuticals, read November 2, 2026.
- Meta authorization after certification; adult audience in the US, Canada or New Zealand8Meta Advertising Standards, Drugs and pharmaceuticals, read November 2, 2026.
- Google certification for prescription drug services7Google Ads policy, prescription drug services, read November 2, 2026.
- No pixels on intake pages; the FTC's 2024 Cerebral order covered data shared through tracking tools11FTC, proposed order against Cerebral, April 15, 2024.
Step 8: launch small
Start with the states your clinicians cover and one offer. Measure every step from ad to first refill before you add anything.
- One offer, one landing page, one channel to start.
- Track quiz completion, approval rate, capture rate and first refill rate.
- Fix the weakest step before you raise spend: why your telehealth company gets traffic but no sales.
Build, partner or all-in-one?
Three ways to assemble the eight steps. The right one depends on your team and capital.
| Approach | You handle | Partner handles | Fits |
|---|---|---|---|
| Build | Structure, clinicians, pharmacy contracts, payments, stack | Lawyers, individual vendors | Teams with healthcare operators and time |
| Clinical partner + your store | Brand, store, checkout, payments, ads | Clinicians, e-prescribing, often pharmacy | Teams with ecommerce skills |
| All-in-one stack | Brand and ads | Storefront, clinicians, pharmacy, payments | Founders who want to focus on growth |

How to scale a telehealth company
Scaling telehealth is not only more ad spend. Each lever has a constraint that ecommerce brands do not face.
| Lever | What to do | Constraint to check | Metric |
|---|---|---|---|
| More states | Add clinicians licensed in new states | State licenses, pharmacy shipping | Approval rate by state |
| More channels | Add Google, then TikTok | Certification per platform7Google Ads policy, prescription drug services, read November 2, 20268Meta Advertising Standards, Drugs and pharmaceuticals, read November 2, 2026 | CAC by channel, on captured payments |
| Higher value per patient | Multi-month plans, add-ons | Clear terms, ROSCA9Restore Online Shoppers' Confidence Act, 15 U.S.C. § 8403 | Revenue per patient at 90 days |
| Retention | Refill reminders, easy pause, dunning | Online cancellation | First refill rate |
| Payment resilience | Second processor, card vault | Each processor's review | Decline rate, failed renewal recovery |

Mistakes that stop telehealth brands
These are the patterns regulators and processors act on.
- Charging before a clinician reviews, or enrolling patients in plans they did not choose; the FTC alleges this in its 2026 complaint10FTC, press release on the complaint against Hims & Hers, July 29, 2026 (allegations; case pending).
- Hard cancellation. Cerebral paid more than $7 million in a 2024 FTC case that included its cancellation process11FTC, proposed order against Cerebral, April 15, 2024.
- Health data in ad pixels10FTC, press release on the complaint against Hims & Hers, July 29, 2026 (allegations; case pending)11FTC, proposed order against Cerebral, April 15, 2024.
- One processor, no backup, on a restricted category4Stripe, Prohibited and restricted businesses, read November 2, 2026.
- Ads to states you cannot serve.
